Rental Conditions

1. Rental service
Rental service includes: the rental of the vehicle for the days and kilometers agreed on the contract; all insurances (art.3); oil and the other engine liquids; ordinary check-up of the vehicle and repairing of damages not due to our customer’s negligence.
The service does not include: petrol, emptying of the dirty water tank, any fine and fee. Should the client be fined by any of the local police authorities during the rental , he/she authorizes Samas S.a.s. to charge on his/her Credit Card euro 60,00 for the refunding of the filing expenses, plus the amount of the fine itself.
2. Vehicle use
The vehicle can be used only as a mean of transportation and dwelling of people.
It’s forbidden:
a) any form of subcontract,
b) to lend the vehicle to people that are not mentioned in the contract;
c) the use of it to carry out professional or commercial activities such as goods’ retailing, etc, etc.;
d) towing of vehicles;
e) driving the van if the driver is not physically and psychologically apt to a safe and lawful driving, or if the driver has had his/her driving
license for less than two years:
f) to exceed the number of people foreseen on the vehicle license.
Any violation of the above terms on the part of the customer, will imply the loss of the cautionary deposit and the immediate return of the vehicle to Samas S.a.s.; moreover, it will imply the payment of any damage caused to SAMAS S.a.s. or to a third party. The driver must drive our motorhome safely and accordingly to the road rules valid in any country he/she finds himself/herself travelling into. He/She/ also has to use the
maximum care when driving the vehicle, to protect the persons and objects present in it.
3. Insurance
The vehicle is insured during the rental period written on the contract;
SAMAS S.a.s. declines any responsibility for any damage occured to the people and objects carried on its vehicles during this period;
SAMAS S.a.s. declines any responsability arising from false declaration (about identity, address, inexact documents…) on the part of the customer.. In case of accident , the customer must fill in attentively the appropriate Accident Report form that must then be sent to SAMAS S.a.s. within 48hrs. SAMAS S.a.s. must be informed as soon as possible, by phone, about the accident. All vehicles owned by SAMAS S.a.s. must not be driven in countries not foreseen in the green card.
The insurance cover includes: third party liability. , kasco and green card with an excess of 1500€. Other types of assistances such as: third party liability and kasco with a 1000€ deductible, theft and robbery, vandalism and roadside assistance in the event of breakdown or accident, can be purchased in accordance with the rates published on the website www.campersardegna.net and shown in the table below this document. In the event of theft of all or part of the equipment, fire or accident, the user must notify the head office within 48 hours by telephone or email. Failing this, he shall be directly liable for any damage or loss resulting from failure to notify SAMAS S.a.s.. whether incurred by SAMAS S.a.s. or by third parties. In the event of damage caused to third-party property or suffered by third parties, the user must complete the claim form in full and have it signed by the other party. In all other cases, the user shall be obliged to request the intervention of the police authorities and verify that the accident reports or notifications include all the personal data of the persons involved, witnesses, and the number plates of any vehicle involved. It shall also be the responsibility of the user to obtain a copy of the police report and provide it to SAMAS S.a.s. within 48 hours of the accident/damage.
4. Responsabilities
SAMAS S.a.s. non sara responsabile di tutte le carenze, guasti o altri vizi non risultanti dal verbale di consegna che il cliente avra redatto insieme ad un responsabile di SAMAS S.a.s.. SAMAS S.a.s. non sara responsabile di disguidi che potessero verificarsi in dipendenza di ritardi involontari o guasti meccanici, negligenze degli addetti al servizio, interruzioni o ritardi nel viaggio dovuti a malattie, calamita naturali, scioperi, guerre, intemperie, quarantene, ecc. In caso di interruzione forzata del viaggio il cliente e tenuto ad informare tempestivamente SAMAS S.a.s. entro le prime 24 ore, affinche possa provvedere al recupero del veicolo nel modo piu adeguato, addebitandone le relative spese al cliente; SAMAS S.a.s. non sarà responsabile di disguidi o ritardi involontari nella consegna o nel ritiro del mezzo, anche se imputabili ai suoi agenti o al suo personale. Il cliente e tenuto al pagamento dell’intero noleggio, anche se impossibilitato a completarlo a causa di incidenti, malattie, calamita naturali, guerre, intemperie, quarantene ecc.; SAMAS S.a.s. non e responsabile per sinistri o infortuni causati al cliente e/o agli altri passeggeri, derivanti dal noleggio dei suoi mezzi di qualsiasi genere essi siano.
5. Rental period
The rental period cannot be modified unless agreed with SAMAS S.a.s. at least 48hrs before its end.. Any delay in the redelivery of the vehicle not authorized by SAMAS s.a.s, will be subjected to the application of a quadruple fare with respect to that applied at the moment of the rental.
6. Booking and payments
To confirm one’s booking, the 50% of the whole rental amount must be paid in advance, otherwise the booking won’t be considered valid. The remaining 50% of the whole rental amount must be paid 30 days before the rental start. An amount of maximum € 1500 must be paid at the beginning of the rental period as legal deposit. It will be refunded after maximum 45 days from the drop off , and after a complete check up of the vehicle. The client is always responsible for any damage caused to the vehicle during the rental period. The payment of any damage caused to the vehicle, shall be drawn, from the legal deposit at the end of the rental period.
7. Renunciation
In case of renunciation of a previously confirmed rental, SAMAS S.a.s. must be soon informed via e-mail, and the amount paid will be withhold in compensation according to the following conditions:
– 30% of the whole rental amount will be withhold if the renunciation is within 51 days from the rental start
– 40% of the whole rental amount will be withhold from 50 days to 21 days before the rental start
– 70% of the whole rental amount will be withhiold from 20 days to 8 days before the rental start
– 85% of the whole rental amount will be withhold if the renunciation is within 7 days before the rental start
– 95% of the whole rental amount will be withhold if the renunciation is on the same day of the rental start or up to 6 days before.

SAMAS S.a.s. can vary the day of the rental beginning in case of breakdowns of its vehicles or even under circumstances beyond its control. If the delay of the vehicle’s delivery is of more than 48hrs, the customer might have his/her amount back and the contract can be cancelled. No other refunding is to be expected by the customer from SAMAS S.a.s.. No refunding or reductions have to be expected in case of anticipated deliveries of any vehicle if not previously agreed with SAMAS S.a.s..
In the unfortunate case that a failure of the chosen vehicle occurs, Samas S.a.s. reserves itself the right to replace it with another vehicle whose features will be as much similar as possible to the previously chosen one.
8. At one’s expense
All expenses due to any transfer of the vehicle to other States, (due) to obtaining authorizations, documents, temporary imports/exports of everything is in the motorhome, included all camping equipment supplied by SAMAS S.a.s., is at the customer’s own expense.
9. Repair service
Should faults to the vehicle occur during the rental period, not due to the absence of ordinary maintenance or to negligence on the part of the customer,the repairs shall be agreed in advance with Samas sas and carried out only after its authorisation. Any sum paid by the customer shall be reimbursed upon return of the vehicle. In the event of puncture/damage/breakage of one or more tyres, the cost of repair/replacement of the same or of the pair of tyres required by the CDS (Italian traffic laws code) shall be borne entirely by the customer. Any damage to the rims will be charged to the customer.
10. Vehicle’s redelivery
Return of the vehicles: the vehicle must be returned internally clean, as at the time of collection and free of personal items; the quantity of fuel on return must be equal to the initial quantity, failing which a penalty of €25.00 shall be applied, in addition to the cost of the missing fuel. A penalty of 60€ shall be charged in the event of: rubbish, sand, animal hair on beds and sofas, and in all cases where the condition of the interior of the vehicle is not attributable to normal use. In addition, the motor home must be returned with the grey water tank empty, the toilet cassette empty and the fresh water tank filled. Failure to do so will result in a charge of €60.00. The customer is responsible for the accessories and equipment in the vehicle. In the event of theft, loss or damage to the equipment, the following penalties shall apply: vehicle keys €350.00, chocks €110.00, electric cable €75.00, camping table €125.00, camping chair €15.00, outdoor mat/carpet €25.00, inverter (when supplied) €65.00, GPS (when supplied) €185.00. Smoking is not permitted in SAMAS S.a.s. vehicles. In the event that there is a smell of smoke inside the motor home upon returning from a rental, the customer will be charged the cost of the anti-smoking treatment, amounting to €300.00, in addition to any additional cleaning costs.
The Client who owns a financial credit card authorises the Lessor to debit the relative account for all charges incurred by the Lessor as a result of the rental relationship, including those indicated in the Contractual Documents and those that may be necessary for the recovery of any type of credit claimed by the Lessor against the Client in relation to the rental relationship.

This contract is governed by Italian law and in case of disputes the competent court shall be the court of Tempio Pausania (SS). For express acceptance of the above mentioned articles: art.1 DESCRIPTION OF THE SERVICE, art.2 USE OF THE VEHICLE AND PROHIBITIONS, art.3 INSURANCE, art.4 LIABILITY, art.5 DURATION OF RENTAL, art.6 BOOKINGS AND PAYMENTS, art.7 CANCELLATIONS, art.8 EXPENSES TO BE CHARGED TO THE CUSTOMER, art.9 REPAIRS, art.10 DELIVERY OF THE VEHICLES.
